Justice Durham special counsel John Durham is reviewing the abuse during the Russia investigation and weighing a possible criminal charge against a DC lawyer who represents the interests of democracy, a person familiar with the matter said Thursday.
Michael Sussman, a prominent cybersecurity attorney and former federal prosecutor, is expected to be indicted for lying to the FBI. This is related to the 2016 contact with the FBI, which is said to have raised the prospect of contact between the Russian bank and former President Donald Trump’s private business with then-FBI General Counsel James Baker. Sussman’s organization, Perkins Koi, represented the Democratic National Committee.
The timing of any charging decision is related to a five-year limitation consideration that expires on Sunday.
The Justice Department declined to comment Thursday. Sussman’s lawyers have denied any wrongdoing by their clients.
This growth was first reported by the New York Times.
Durham tapped former Attorney General William Barr in 2019 to investigate possible surveillance abuse by the FBI during the Russia investigation.
Since that appointment, the Connecticut federal prosecutor’s investigation has led to a conviction against an FBI lawyer who admitted the mistake of changing the email he used to justify surveillance of former Trump campaign adviser Carter Page.

Prior to leaving office in December, Barr appointed Durham as special counsel for the Justice Department, which ensured that Biden’s administration would continue its investigation.
Former President Donald Trump has urged the results of the investigation to be made public during the 2020 campaign, but Barr later said the coronavirus epidemic slowed the pace of inquiry, preventing the expected completion before the election.
The Trump inquiry has been the subject of his campaign, arguing that the Obama administration-led FBI and the Justice Department have tried to undermine his candidacy.
