The Supreme Court refused in 2019 to hear his appeal after the Ninth Circuit rejected Kennedy’s case. As part of the Supreme Court’s initial decision, four conservative justices – Thomas, Alito, Kavanagh and Gorsuch – suggested that Kennedy’s case could succeed after the next lawsuit.

“The First Amendment really means a lot to me,” Kennedy said last year Appearing on LBL. “It’s really horrible that anyone in America today can be dismissed for expressing their faith. So I’m fighting. So no one else has to go through this and have to choose between their work and their faith.”

The Bremerton School District, through its lawyers in American United to separate church and state, issued a statement about the court’s decision to review the case.

“No child attending public school should pray to play school sports,” said Rachel Laser, president and CEO of American United. “No student should ever be excluded – be it in the classroom or on the football field – because they do not share the religious beliefs of their coaches, teachers or fellow students.”

“Bremerton School District followed the law and protected the religious freedom of students when its football coach stopped conducting forced prayers with players on the 50-yard line after high school football games,” Laser added. “Public school children and their families – like all of us – have the constitutional right to believe that they are chosen and treated equally by their public schools, regardless of their beliefs. The Bremerton School District has served a legal duty to respect their fundamental rights.”
