Vaccination must be terminated in Canada: lawyer


HALIFAX – Canada faces a potential wave of compulsory workplace vaccine policies because a growing number of employers must vaccinate workers completely against Kovid-19 – or at risk of losing their jobs, legal experts say.

Governments, organizations and companies have spent months encircling vaccine orders to prevent the persistent epidemic that is being fueled by mutations.

Advocates say that vaccine workers can be placed on unpaid leave sooner or completely terminated, as the employer’s deadline is a purely vaccine method.

“Thousands of people across Canada have contacted us, who have these ultimatums, who must be vaccinated by a certain date or risk losing their jobs,” Suffer, Partner with Suffer Tumarkin LLP said in an interview.

“We’re going to see the biggest terminations we’ve seen since the epidemic started,” he said, adding that workers from several industries, including healthcare, education, banks, construction and restaurants, have approached the firm. .

“It’s going to be significant.”

Prime Minister Justin Trudeau released Canada’s new mandatory vaccine policy on Wednesday. This requires major public service, air travel and rail employees to be vaccinated against Kovid-19 by the end of October.

The federal vaccine mandate reflects provincial policies, such as that in Nova Scotia, all school and health-care workers must have a two-dose Covid-19 vaccine by the end of November.

Private companies have developed corporate vaccine orders, and staff have been given a deadline to vaccinate.

Legal experts face the tension between protecting individual workers’ rights and ensuring employers meet their health and safety obligations to staff, customers and the public.

There is also the question of what reasonable accommodation or exemptions should be available to workers and whether compensation should be granted to employees who are ultimately dismissed.

“There is an overriding obligation on employers to make sure the workplace is safe,” said Ron Pizzo, a labor and employment lawyer with Pink Larkin in Halifax.

“Kovid is a serious illness. With the possibility of life threatening, the risk of harm is very high,” he said. “Employers have a duty to keep their workplace safe and impose those policies for valid reasons.”

Pizzo said his firm is getting a lot of calls from people who don’t want to be vaccinated and want to fight employer vaccination requirements.

Still, he said he is not expecting mass resignations, which leaves companies with insufficient labor if given the relatively high vaccination rate in the general population. A little more than 80 percent of all Canadians age 12 and older are fully vaccinated.

Pizzo added that many law firms are introducing mandatory vaccination policies for face-to-face meetings in the office.

Vale Mackay, a professor emeritus at Dalhousie Schulich School of Law, said employers should balance workers’ personal rights, maintaining a safe work environment by providing reasonable amenities.

But a recent review of cases involving the balance between individual rights and public health is bound for the latter, he said.

“I went through a lot of cases and jurisdictions, and for the most part, personal rights are important and you have to do everything you can to honor them. During the epidemic, reasonable limits are given a wide range,” Mackay said. “Most of the sanctions that governments are doing are found to be consistent with the Kovid-19 threat.”

Although these cases do not specifically deal with vaccine mandates, the same reasoning is likely to apply, he said.

Mackay said that for medical reasons, there are some legitimate reasons to seek immunity from vaccine policy.

Some workplaces, however, have a mandatory vaccination requirement than others, he said.

“If you can work individually from home, you don’t need that person to be vaccinated as part of their job,” Mackay said. “If you are in the public sector and serving the public, vaccination is a very reliable case to be required.”

Are workers fired for refusing to be vaccinated are entitled to compensation, depending on the work environment, the need for the policy, and whether the worker is union or not?

Suffer It has been suggested that workers who have been fired for not paying the appropriate compensation may be dismissed incorrectly.

“The employer is imposing a new rule that was not part of the original employment contract,” he said. “It expires without cause and the separation must be paid. Beyond that, there may be a human rights claim.
